Terms and Conditions of Service

1.1 Binding Agreement

By creating an account, accessing the 49ji website, using our mobile applications, or engaging with any aspect of the Service, you enter into a binding legal agreement with 49ji and acknowledge your acceptance of these Terms. This acceptance occurs automatically upon your first use of the Service and continues for the duration of your relationship with 49ji.

1.2 Capacity to Contract

You represent and warrant that you possess the legal capacity to enter into this Agreement. You must be at least 21 years of age to use the Service, as mandated by Philippine gaming regulations. By using the Service, you affirm that you meet this minimum age requirement and that all information you provide to 49ji is accurate, current, and complete.

1.3 Modifications to Terms

49ji reserves the right to modify, amend, or update these Terms at any time, at our sole discretion, with or without prior notice. We will make reasonable efforts to notify users of material changes through email notifications, platform announcements, or other appropriate means. Your continued use of the Service following such modifications constitutes acceptance of the revised Terms. If you do not agree to modified Terms, you must discontinue use of the Service immediately.

2.1 Age and Jurisdictional Requirements

You must not share your login credentials with any third party. You agree to notify 49ji immediately of any unauthorized access to or use of your account. 49ji is not liable for any losses arising from unauthorized account access resulting from your failure to maintain credential security.

3.2 Account Activity Responsibility

You are fully responsible for all activities that occur under your account, whether authorized by you or not. This includes all deposits, wagers, withdrawals, and other transactions. 3.3 Account Sharing Prohibition

All deposits are processed in Philippine Pesos (PHP) unless otherwise specified for cryptocurrency transactions. You agree to only use payment methods in your own name and for which you are the authorized account holder.

4.2 Withdrawal Processing

Withdrawal requests are processed subject to verification of your identity and compliance with applicable regulations. 49ji reserves the right to request additional documentation before processing withdrawals. Withdrawal processing times vary by payment method and are provided as estimates only. We endeavor to process withdrawals promptly but do not guarantee specific processing timeframes. 4.3 Transaction Fees and Charges

49ji does not charge fees for deposits or withdrawals under normal circumstances. However, your payment provider may impose fees for which 49ji is not responsible. Currency conversion fees may apply for cryptocurrency transactions. You are responsible for all fees, charges, and taxes associated with your use of payment methods.

4.4 Anti-Money Laundering Compliance

49ji maintains strict anti-money laundering policies in compliance with Philippine law and international standards. We reserve the right to reject or return any deposit that we believe may be connected to money laundering or other illegal activity. Suspicious transactions will be reported to appropriate authorities as required by law. Accounts involved in suspicious activity may be suspended pending investigation.

5.1 Fair Play Requirements

All players must engage in fair play and comply with the rules of each game. You agree not to use any automated systems, bots, collusion, or other unfair methods to gain advantage. 7.2 Limited License

Subject to your compliance with these Terms, 49ji grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your personal entertainment purposes. This license does not include any resale or commercial use of the Service or its contents, any derivative use of the Service or its contents, or any downloading or copying of account information for the benefit of another party.

8.1 Restricted Conduct

You agree not to engage in any of the following prohibited activities:

• Creating or using multiple accounts to circumvent restrictions or gain unfair advantage
• Engaging in any form of cheating, collusion, or fraud

• Transmitting viruses, malware, or other harmful code

• Harassing, threatening, or abusing other users or staff

8.2 Consequences of Violations

Violation of prohibited activity provisions may result in immediate account suspension or termination, forfeiture of all account balances and winnings, legal action, and reporting to appropriate law enforcement authorities. 49ji reserves the right to determine whether conduct violates these Terms in our sole discretion.

9.1 Right to Suspend or Terminate

49ji reserves the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons for account suspension or termination may include but are not limited to violation of these Terms, suspected fraudulent activity, requested verification documents not provided, extended account inactivity, or regulatory requirements. Upon termination, your license to use the Service terminates immediately.

9.2 Effects of Termination

Upon account termination, you must immediately cease all use of the Service. Legitimate withdrawable balances in terminated accounts will be returned to you after deduction of any amounts owed to 49ji, subject to verification requirements. Bonus balances and unfulfilled wagering requirements will be forfeited. 49ji may retain certain account information as required by law or for legitimate business purposes.

9.3 Self-Exclusion

You may request self-exclusion from the Service at any time through customer support or responsible gaming tools. Self-exclusion periods can be set for specific durations and will prevent you from accessing your account during the exclusion period. Self-exclusion cannot be reversed before the specified period ends. 49ji will use reasonable efforts to prevent you from opening new accounts during self-exclusion but cannot guarantee prevention of determined circumvention attempts.

10.1 No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. 49ji DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 49ji SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL 49ji'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU DEPOSITED INTO YOUR ACCOUNT DURING THE SIX MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

10.3 Technical Failures

49ji is not liable for any losses resulting from technical failures, including but not limited to server outages, internet connectivity problems, payment processing errors, or game malfunctions. In the event of game malfunction, all affected wagers and payouts are void. We will make reasonable efforts to restore service and address technical issues promptly but provide no guarantees regarding service availability or performance.

11.1 Informal Resolution

In the event of any dispute arising from or relating to these Terms or the Service, you agree to first contact 49ji customer support to attempt informal resolution. Most disputes can be resolved quickly through direct communication with our support team. You agree to make good faith efforts to resolve disputes informally before pursuing formal dispute resolution.

11.2 Binding Arbitration

Any dispute that cannot be resolved informally shall be resolved through binding arbitration conducted in accordance with the rules of the Philippine Dispute Resolution Center, Inc. or similar arbitration body. Arbitration will be conducted in English in Metro Manila unless otherwise agreed. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction. YOU AGREE TO WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS OR CLASS ARBITRATIONS.

11.3 Exceptions to Arbitration

Notwithstanding the arbitration provision, either party may seek equitable relief in court for infringement or misappropriation of intellectual property rights. Additionally, disputes involving amounts below a specified threshold may be resolved in small claims court.

12.1 Modification Rights

49ji reserves the right to modify these Terms at any time in our sole discretion. We will provide notice of material changes through email, platform notifications, or other appropriate means. The "Last Updated" date at the beginning of these Terms indicates when changes were last made. Your continued use of the Service following notice of changes constitutes acceptance of the modified Terms.

12.2 Review Obligation

You are responsible for regularly reviewing these Terms to stay informed of updates. We recommend checking these Terms periodically, particularly before engaging in activities that may be affected by modifications.

13.1 Applicable Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict of law principles. All gaming activities are subject to Philippine gaming regulations and oversight by appropriate regulatory authorities.

13.2 Jurisdiction

Subject to the arbitration provision above, you agree that any legal action or proceeding arising from or relating to these Terms shall be brought exclusively in the courts of Metro Manila, Philippines. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

14.1 Entire Agreement

These Terms, together with our Privacy Policy and any specific rules or terms applicable to particular promotions or games, constitute the entire agreement between you and 49ji regarding use of the Service and supersede all prior agreements and understandings.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from these Terms and the remaining provisions shall remain in full force and effect.

14.3 Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. 49ji's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your account to any third party without 49ji's prior written consent. 49ji may assign these Terms or any rights hereunder without restriction. Any attempted assignment by you in violation of this provision is void.
